This week one of our Collection Agency Research Assistant members brought Phoenix Law and Ty Carss to our attention. They have received nearly 400 robo cease/dispute letters including a request for settlement from Phoenix Law in less than 2 weeks! Needless to say there’s some issues to unpack here and potential risk. You can find an example of the letters being sent here, this redacted example is for one specific consumer account.
The general tone of these letters feels more like a debt settlement company rather than a law firm, although we did confirm William Taylor Carss is licensed in California. Upon additional research we found the following press release dated April 7, 2023 Phoenix Law Announces the Appointment of Ty Carss to the Position of Managing Attorney that states “Headquartered in Los Angeles and led by Managing Attorney Ty Carss, Esq., Phoenix Law provides comprehensive law services for clients who are seeking debt resolution. With decades of experience in debt litigation, the dedicated team of attorneys offers best-in-class services and customized solutions to resolve debts. Since launching, our firm has already helped thousands of clients in 48 states reach financial stability through consumer rights protection, the dispute process, and legal representation. Our extensive team serves clients in every state with the exception of Idaho and North Dakota.”
Collectively, Research Assistant members agreed that attempting to work with Phoenix Law would be a good idea, perhaps even have a positive outcome. It’s still to be seen if that will prove out to be true but it’s important to keep an eye on the trends from this firm.
