Last week, several of us attended ACA International’s Annual Convention during this week’s call, those of us in attendance debriefed on a few of our takeaways. One takeaway stood out, there’s a lot of new technology trying to solve everyday operational problems. It’s easy to get excited about new technology and operators are often the first to want to dive in, but as compliance professionals we usually take a more cautious approach. 

So what are a few things to remember when vetting a new technology vendor, especially one offering a service that is new to the industry? 

First, you must understand the technology specifically how the technology will be deployed. For example, if it’s being deployed through Voice over Internet Protocol (VoIP), short-code, or long codes you may need to evaluate if the technology presents TCPA risks. 

Second, make sure to evaluate all laws related to the potential solutions, not just the FDCPA. Specifically, state laws and how they may impact the effectiveness of the solution. 

Lastly, ask for case studies and use cases. It’s important for decision makers to understand what is the risk-benefit reward and what controls will need to be added to compliantly use any new solution?
