On Tuesday we brought you news from Troutman Pepper Locke detailing a litigation win for a debt collection agency in a case where a debt collector sent a consumer validation documents in response to a combined dispute/cease communication letter. In debt collection litigation, it seems new theories to create FDCPA liability are created every day, particularly when it comes to letters. Though from a District Court, opinions like this one are good to keep on hand should your organization face a similar suit or threat of suit.
On Wednesday we brought you an article from Venable, LLP discussing the evolving role of compliance during the current shift toward deregulation. Less oversight doesn’t mean less compliance. This article provides an easy-to-read rundown of how we should be thinking about compliance in this changing environment. It’s a must read for ARM industry stakeholders to stay ahead of the curve.
On Thursday we published an update from Orrick on litigation filed by a physician against the three major credit reporting companies regarding their decision to refrain from including medical debt below $500.00 on credit reports. This case is interesting because it shows the medical community’s thoughts on the cessation of including certain medical debts on credit reports. It’s something for any stakeholders collecting medical debt to watch for.
