CHARLESTON, WV – Attorney General Darrell McGraw’s office has accused a New Jersey company and its owner of using abusive and deceptive tactics to collect bad check payments from about 7,600 consumers.
A lawsuit filed on Wednesday alleges that JBC Legal Group, a collection agency, wrongfully attempted to collect on time-barred bad checks by threatening to sue consumers and by accusing them of fraud.
Time-barred checks are those for which the statute of limitations for collection lawsuits has expired. In West Virginia, the statute of limitations is three years. Some of the alleged bad checks were 10 years old, said Assistant Attorney General Norman Googel.
“The checks tend to be so old that consumers tend to not remember if they wrote the check or not,” Googel said.
