Predicting Bankruptcies

While interest in predicting bankruptcy filings has most often been confined to academics, using models that are heavy into mathematical analysis, with the increased use of both PCs and the Internet, the ability to attempt to predict bankruptcies is now a little more available than in the past. Such models as the Springate model have been around for a decade. The model, developed thirty years ago by Gordon Springate in Canada, employs what is referred to as “step-wise” multiple discriminant analysis that is used along with certain financial ratios to distinguish between sound businesses and those that actually failed.

Other such insolvency predictors are the Altman model, which was designed by Edward Altman over twenty five years ago that originally achieved a 95% accuracy rate.

Springate and Altman are not the only models, however. The Fulmer model is a more recent U.S. model that evaluates forty financial ratios, but was shown to only have a 50% success rate. Finally, one of the only “business failure” prediction methods that was not developed using multiple discriminant analysis was the Blasztk system, developed in Canada by William Blasztk. The essence of this system is that the financial ratios of a seemingly insolvent firm are compared with ratios for average companies in the same industry–an obvious strength over other bankruptcy failure models.

Could the Carmakers’ Swift Move Through Bankruptcy Be Setting a Trend?

Bankruptcy experts and creditors have closely watched the Chrysler and General Motors bankruptcies, both of which were moved through the U.S. Bankruptcy Court with surprising speed. One of the main questions being raised is whether the two carmakers’ rapid course through the court is a harbinger of things to come in future bankruptcy reorganizations. In both cases, much was made of section 363 of the Bankruptcy Code, which allows bad assets to be sold off to leave the healthier parts of the company behind. Asset sales under 363 have often been used of course, and, according to some, 363 has seen increased use over the past ten years or so. But it was nonetheless surprising in the Chrysler and GM cases to see 363 used so swiftly on such large companies. One big worry is that pushing through 363 left creditors with less to say and less time to object to the planned reorganization of the car companies. Officials from the Obama administration, which pretty much forced through the 363 asset sales, especially in the GM case that leaves the government a 60% owner, claim that the two automakers’ bankruptcies don’t necessarily mean that the application of bankruptcy law will be very different in the future. One of the main factors in both cases is that if there hadn’t been quick action both carmakers likely would have been headed for liquidation, with potentially devastating economic and political consequences.

Alamo Discount Pharmacy Inc. filed Chapter 11 in the U.S. Bankruptcy Court for the Southern District of Georgia. The firm listed assets of between $100,000 and $1 million and liabilities of between $1 million and $100 million. The filing was under case number 09-30387. Allotech International LLC filed Chapter 11 in the U.S. Bankruptcy Court for the District of Delaware. The firm listed assets and liabilities of between $100 million and $500 million each. American Homebuilders Inc., a construction, engineering and homebuilding company, filed Chapter 11 in the U.S. Bankruptcy Court for the Middle District of Florida. American Ironhorse Motorcycle Co., Fort Worth, Tx., filed Chapter 11, hoping to reorganize and resume making its custom motorcycles in a newer factory. American Ironhorse, dragged down partly by the weak economy, has retained Liquid Asset Partners LLC in Grand Rapids, Mi. to sell all of its motorcycle backlog, manufacturing equipment and other items. The company, which halted production back in February, is hoping to sell the assets as it seeks new investment so that it can restart production of its motorcycles.

Aurora Oil & Gas Corp., a Traverse City, Mi. natural-gas concern, filed Chapter 11 in the U.S. Bankruptcy Court for the Western District of Michigan. The firm listed assets of between $100 million an $500 million. The filing was under case number 09-08254. For more information contact the court at 866-729-9098.

Aventine Renewable Energy Holdings Inc. has seen a 9/8 deadline set for filing proof of claims in its Chapter 11 bankruptcy. For further information contact the U.S. Bankruptcy Court in Wilmington, De. at 302-252-2960.

Ballet Florida, facing financial pressures for years, filed Chapter 7. The filing, which listed assets and liabilities in the range of $1 million to $10 million each, was made in the U.S. Bankruptcy Court in West Palm Beach, Fl.  A creditors’ meeting has been scheduled for 8/3.

Bashas’ Inc., a Chandler, Az.-based chain of grocery stores, filed Chapter 11 in the U.S. Bankruptcy Court in Arizona. Armed with a $45 million credit line, the firm intends to continue operating and exit Chapter 11 in the first quarter of next year. Bashas’, which over the winter downsized its staff, has now fingered ten stores that it will close, on top of five other stores it shuttered earlier in the year. By one estimate, the company’s assets are valued at between $100 million and $500 million. The filing, under case number 09-16050, was on 7/12. BearingPoint Inc., the bankrupt McLean, Va.-based management and tech-consulting company, continues its strategy of selling assets, saying it will sell its operations in Brazil to CSC of Falls Church, Va. for an undisclosed amount. The sale must still be approved by the U.S. Bankruptcy Court. Last week BearingPoint agreed to sell certain assets of its public-services unit in North America to Keene Inc. of Boston, Ma.

Blaine Hospitality LLC filed Chapter 11 in the U.S. Bankruptcy Court in Minnesota. The firm listed assets and liabilities of between $1 million and $100 million each. The filing, under case number 09-44554, was on 7/13. For more information contact the court at 800-959-9001. 

B&N Container Inc. filed Chapter 11 in the U.S. Bankruptcy Court for the Northern District of Illinois. Byram Ready Mix Inc. filed Chapter 11 in the U.S. Bankruptcy Court for the Southern District of New York. Cabrini Medical Center filed Chapter 11, pressured by an increase in the number of poor patients coupled by declining Medicaid and Medicare reimbursements. The filing, in the U.S. Bankruptcy Court for the Southern District of New York, listed assets of $46 million and liabilities of $167 million as of the end of May. CCS Medical Inc., Clearwater, Fl., filed Chapter 11 in the U.S. Bankruptcy Court for the District of Delaware. Also filing for bankruptcy protection were MP TotalCare Inc., Sanvita Inc., Chronic Care Solutions Inc. and at least fifteen other related entities. Consolidated Resorts Inc., a Las Vegas, Nv.-based timeshare development firm, filed Chapter 7 amid credit pressures. The filing, in the U.S. Bankruptcy Court in Nevada, listed assets of between $1 million and $10 million and liabilities of between $100 million and $500 million. The bankruptcy filing doesn’t affect Consolidated’s fourteen resorts since they are owned by timeshare owners and managed by entities that aren’t part of the filing.

Doughboy LLC, an Overland Park, Ks. owner of Uno Chicago Grill restaurants, filed Chapter 11. The company, which has been in a rent dispute with its landlord and a tax battle with federal officials, listed assets and liabilities of $3.4 million and $5.5 million respectively. Doughboy said it intends to continue operating as it restructures.

Electroglas Inc., a San Jose, Ca. manufacturer of probes that inspect for defects in semiconductor wafers, filed Chapter 11 in the U.S. Bankruptcy Court for the District of Delaware. The firm listed assets and liabilities of between $1 million and $100 million each. The filing was under case number 09-12416. Also filing for bankruptcy protection was Electroglas International Inc. Frontier Airlines Inc., the bankrupt Denver, Co. carrier, said that the number of passengers boarding its flights in June fell nearly 11% from the year-ago month–to about 895,000 passengers.

Journal Register Co.’s recently confirmed Chapter 11 bankruptcy reorganization plan provides for a 9% cash distribution for unsecured creditors, among other details. Also, the Yardley, Pa. newspaper publisher will get two loan facilities totaling $225 million.

KC’s Market & Deli Inc. filed Chapter 11 in the U.S. Bankruptcy Court for the Western District of Tennessee. The firm listed assets and liabilities of between $1 million and $100 million each. LaVigne Inc.,a Worcester, Ma. printing services firm that operates as LVI Print Optimization, filed Chapter 11. According to bankruptcy documents, LaVigne is looking at offers from various suitors but is leaning toward a buyout bid from Hubcast Inc. In its bankruptcy filing, LaVigne, which helps streamline and supervise printing operations for its customers, listed assets and liabilities of between $1 million and $10 million each.

Lear Corp., the Southfield, Mi. maker of auto parts, received approval from the U.S. Bankruptcy Court to use its debtor-in-possession financing facility and other available cash to fund operations.

Masa Development LLC filed Chapter 11 in the U.S. Bankruptcy Court for the Southern District of West Virginia. The firm listed assets and liabilities of between $1 million and $100 million each. NV Broadcasting LLC, Atlanta, Ga., filed Chapter 11, hoping to slash its debt by more than $400 million and raise more capital. Already, the company has arranged for $30 million in new financing and the firm said it will continue operating as usual. The bankruptcy filing, in the U.S. Bankruptcy Court for the District of Delaware, listed assets of between $10 million and $50 million and liabilities of between $100 million and $500 million. Oscient Pharmaceuticals Corp., a Waltham, Ma. pharmaceuticals and biotech company which recently filed Chapter 11, is in a deal with Cornerstone Therapeutics to sell its FACTIVE-related assets for $5 million, along with the value of the inventory involved. QSGI Inc., a Palm Beach, Fl. data-security concern, filed Chapter 11 hoping to continue operating as it restructures its finances and operations. The filing, in the U.S. Bankruptcy Court in West Palm Beach, Fl., listed assets of about $24 million and liabilities of $22.7 million.

RathGibson Inc., a Lincolnshire, Il.-based manufacturer of tubing products, filed Chapter 11 in the U.S. Bankruptcy Court for the District of Delaware. The company said that the filing won’t affect its daily operations and that it has raised $80 million in a debtor-in-possession facility. The firm also provided a reorganization plan under a consensual agreement with noteholders that also provides for general unsecured creditors to be paid in full. RathGibson’s filing, with assets of between $100 million and $500 million, was under case number 09-12452. Also filing for bankruptcy protection were three of RathGibson’s affiliates.
