TCPA suits against collection agencies continue to be a growing concern. In August of 2014, TCPA suits are up a whopping 33.6 percent from 2013 numbers.

What might be behind this increase?

For one thing, consumers are moving, en masse, to mobile providers over landlines. A Pew report from 2013 states that 91 percent of adults have a cell phone of some kind. This presents a challenge to those in the debt industry, because of the byzantine rules in place for how debt collectors can contact consumers via cell, making it even harder for right-party contacts.

The safest way to contact a mobile number is by manually dialing it (i.e., not using an autodialer). This, of course, leads to fewer contacts.
