BOISE, ID – The Idaho Department of Finances is suing a New Jersey collection agency accused of operating in Idaho without a permit.


The state claims National Check Control repeatedly operated as a collection agency in Idaho without first getting a permit, and that the company violated a cease and desist order the department filed in March.


Gavin Gee, director of the Idaho Department of Finance, says consumers have an obligation to pay their debts. But, he says, collection agencies must deal openly, fairly and only with a license.


The state is asking for an injunction preventing violations of the Idaho Collection Agency Act, and restitution to residents.


National Check Control is already barred from doing business in West Virginia, the result of a lawsuit filed against the firm in May by that state’s attorney general.
