As a parting gift, outgoing West Virginia state Attorney General Darrell McGraw “announced subpoena enforcement action filings on Dec. 20 against three companies for allegedly unlawful debt collection activities.” For the time being, these are only subpoenas — a first step in investigating and determining if, actually, violations have occurred. McGraw, however, will not be the one dealing with these subpoenas and investigations. Having lost his his bid for a sixth term in November, Republican Patrick Morrisey will take over in January.

The philosophy behind collecting debt has evolved. Collectors’ role in the relationship between consumers and their debt is now more of a sales dynamic: Customer service tools serve collectors better in the long run when interacting with consumers than the more strong-armed tactics of the past.
Compliance around TCPA is murky and fraught. Not using a dialer at all isn’t necessarily the best business practice, but using a dialer to call cell phones can put a company on the wrong side of the statute. Technology options exist that can help with TCPA compliance — but none are without some risks.
The challenges of being compliant are legion, the requirements are complex, and the target is a constantly moving one. And yet, compliance standards offer the collection industry a great opportunity to take more responsibility for their actions, and to conduct business more professionally in the interests of all the parties involved.
