Barney Frank Files Bill Exempting Collectors from Liability on Voice Messages

U.S. Rep. Barney Frank (D-Mass.) introduced legislation in the House Tuesday with language that appears to directly address liability issues that arise when debt collectors leave voice messages for consumers concerning a debt. The bill’s text was made available late Wednesday.

This is potentially very important legislation for the ARM industry, and we’ll have much more information on it when it becomes available.

Unverified Debt Collection Complaints Rise in FTC’s 2011 Report

Complaints about debt collection practices jumped nearly 20 percent in 2011, according to data released late Tuesday by the Federal Trade Commission. But complaints specifically regarding third party debt collection agencies soared more than 30 percent, as creditors saw their debt collection complaints fall.

ACA International noted that complaint numbers should be read with caution, as they are unverified and often do not represent rule-breaking activity.
